Subcontractor Insurance Limits and Requirements

The Subcontractor shall purchase and maintain insurance of the following types of coverage and limits of liability:

  • Workmen’s Compensation and Employer’s liabilitycoverage in a form satisfactory to Contractor and meeting the requirements of the State in which the work is to be performed and sufficient to cover Subcontractor’s maximum liability under the applicable so-called Workmen’s Compensation and Occupational Disease Laws, with minimum limits of $1,000,000 each employee/ $1,000,000 each accident/ $1,000,000 policy limit.  Waiver of Subrogation in favor of Leander Construction, Owner and Architect. 

 

  • Comprehensive general liabilityinsurance coverage with limits of $1,000,000.00 per occurrence (bodily injury and property damage), $1,000,000 per person or organization ( personal and advertising injury), $2,000,000  general aggregate on a per project basis, $2,000,000 products/completed operations aggregate and including Leander Construction, Inc., Owner, and Architect/Engineer as a primary and non-contributory additional insured to include both on-going operations as well as completed operations must be equivalent to ISO Form CG 2010 (11/85) or a substitute form providing equivalent coverage,  such as CG2010 (7/04) along with CG2037 (7/04) and additional insured coverage must be maintained for 5 years following contract completion.
  • Commercial Automobile Liability with minimum limits of $1,000,000 combined single limit for bodily injury and property damage. Automobile liability is to name Leander Construction, Inc. as an additional insured.
    • Limit - $1,000,000

 

  • Umbrella-Bodily Injury & Property Damage Combined Single Limit
    • Policy Aggregate Limit - $2,000,000
    • Policy Occurrence Limit - $2,000,000

 

  • Waivers of Subrogation will be required for General, Liability, Auto Liability, Workers Compensation and Excess/Umbrella Liability.

Coverage’s, whether written on an occurrence or claims-made basis, shall be maintained without interruption from date of commencement of the Subcontractor’s Work until date of final payment and termination of any coverage required to be maintained after final payment to the Subcontractor.

Subcontractor shall require any entity it hires to provide any services under the Contract Document to provide evidence of insurance equivalent to the requirements of Subcontractor as set forth within the Subcontract Agreement or subsequent Work Authorization, but in no event shall the coverages and limits be less than those specified within this section.

Certificates of insurance acceptable to the Contractor shall be filed with the Contractor prior to commencement of the Subcontractor’s Work.  These certificates and the insurance policies shall contain a provision that coverages afforded under the policies will not be canceled or allowed to expire until at least 30 days prior written notice has been given to the contractor.
